in June 2005 I asked for separation from my husband. I am a British National with a permanent residence permit for Malawi, & worked in Malawi since 1994. I applied for divorce which Justice Esme Chombo threw out, She seemed to use archaic common law, I was to be domiciled with my husband in Zambia, where he farms, 1 hour drive from Lilongwe. Our new constitution gives a woman freedom to choose her own domicile. My italian Husband took my daughter away unceremoniously aged7, leaving me with my son of 5. Justice Chombo Then astonishingly agreed to hear my husbands application for custody of our children, when earlier had seen all the relevant documents, proving husband domiciled in Zambia. She awarded him interim custody, pending divorce. She heard an ex parte injunction to take my vehicle away, that husband bought as a gift to me, and Registered in my name. My son needed to get to school and me to work, but said he would not assist. Justice Chombo did not follow the ex-parte inj. with inter partes hearing denying me Natural justice. 4 years later, following the correct channels, await the return of my children who have rights to be raised by both parents, and even be consulted on what they want. Justice Chombo, I discovered the day after hearing the ruling, is related to the Kadzamira Family whose mother was the official hostess to the late Hastings Banda. My husbands family & this family are extremely close friends, The Bizarro family. They sewed up the application from the start, by knowing the Judge well, a legal conflict of interest, and corrupted this judge. Chombo knows no family law, a mere solicitor for the previous Banda regimes Press Corporation. She left a week before the ruling read, to do a crash course in Gender and Child Rights. She was promoted to judge as a political favour. it is my opinion she should never preside over another case in her life. The 40 page ruling, was illogical, and openly biased. It is unfortunate for Madonna, that at the time of her application for adoption, all the real, clean judges, have been rightly promoted to the supreme court. Chombo has impacted huge damage on the health of my elderly mother, and the rest of my family. She is totally incompetent. She denied you Mercy as knew my appeal was coming up, and desperately anxious to delay, as knew the ruling an extremely embarrassing, revealing her total incompetence in the role of a Judge, and dangerous. My husbands family have a long list of human rights violations, on their Malawian Staff.Chombo has no knowledge of childs rights, which are clearly read in the 1995 constitution. These children are to be with their mother, who did not do anything but love them, but their damaged minds by this Ignorant Italian family, made possible by a totally useless Judge.
